Who should pay for damages when neighbors tree falls in my yard destroying my fence?
In SC, a neighbor’s tree fell in my yard, destroying my fence, who should pay for clean up and new fence??

Your neighbor, unless you knocked down the tree, or if someone else knocked down the tree. But other than that… your neighbor for property damage.

I am thinking neighbor. The owner of the tree’s insurance company will likely pay. If they won’t, you may be able to get your homeowners insurance to pay.

If the neighbor was aware of degraded condition of the tree and failed to do anything about it, him. Otherwise, it’s considered an act of God and it is on you, or your homeowner’s insurance.

Unless you had any hand in the tree falling onto your property and the tree was clearly on your neighbor’s property, it is his responsibility. His home owner’s policy should cover this.

I am in Oklahoma. I have had neighbors tree damage 3 times through the years. 3 trees, 2 neighbors. their tree, my damage, they pay. gods will or act of god has nothing to actual damage.

As it was your neighbor’s tree, located on his/her property, the one to pay will be his/her homeowners insurance company. Doesn’t matter if it was an act of God or the tree was not properly maintained or not.
Now if the neighbor is a tenant, then it is the landlords insurance that pays.
Don’t touch anything unless the tree is blocking an alley or a driveway and I would take pictures before moving anything even then. Take a lot of pictures of the damage and keep copies for your protection.
